Associated Discrimination

This Dossier starts by offering you a definition of the concept of associated discrimination. Furthermore, it gives you an overview of the judicial interpretation of associated discriminationby outlining judgments of the European Court of Justice (ECJ) and European Court on Human Rights (ECtHR), as well as briefly describing the situation on the UN-level. Moreover, you will find information on associated discrimination at the international level, especially concerning the legal situation in European countries and some other countries.

In Germany, the “Allgemeines Gleichbehandlungsgesetz”, the General Act on Equal Treatment offers judicial protection for people, who have been discriminated against. However, it does not explicitly include the term “associated discrimination”, which the ECJ held as a violation of the Directive 2000/78/EC. Nevertheless, there are two casesthat can be found in the German jurisprudence.
