Reform of the Federal Police Act

The Federal Police Act executes the tasks and powers of the Federal Police. The majority of the law dates back to 1994 and will now be revised. The Federal Police is, among other things, responsible for border protection and the prevention of illegal border crossings.

The Federal Ministry of the Interior and Community proposed a draft law for the reform of the Federal Police Act on May 9, 2023. Amongst other things, the draft law aims to prevent so-called „racial profiling“. A receipt for the identity check will then be provided.

In the past, BUG has supported multiple lawsuits concerning „racial profiling“ during identity checks without initial suspicion. On the grounds of those experiences, BUG has submitted a statement for the reform of the Federal Police Act concerning prevention of „racial profiling“. The legal basis for identity checks without initial suspicion as well as the treatment of non-binary people at the hands of the police constitute key apects of this statement.
