Headscarf ban in the gym

Regional Court of Bremen, judgment of 21.06.2013 - 4 S 89/12

The applicant was prohibited from wearing a headscarf in the gym.

It is considered as discrimination based on religion. The claimant lodged an action based on the AGG.

The prohibition of wearing a headscarf in the area of the devices constitutes in this case, according to the opinion of the court, no discrimination on ground of religion, if it exists to avoid health hazards that may result from wearing headscarves. The Court did not consider alternative ways to cover the hair. Therefore the access to a sport club is not possible for the woman when wearing a headscarf.
