§ 5 AGG allows only the implementation of positive action. This alone is insufficient. A legal foundation and incentive systems beyond supporting women and people with disabilities are lacking. Other European countries have already introduced legislation with stronger obligations. BUG recommends more efforts to be made for an introduction of obligatory affirmative action and for their expansion to cover additional groups that experience disadvantaging treatments.
