In US law, not only does the concept of associated discrimination refer to three-person constellations, but also the case group of “third party reprisal claims”. This prohibition is intended to ensure protection against discrimination in the workplace if a person is associated with a person who is defending himself or herself against discrimination. An example of a case is Thompson v. North American Stainless. An employee was dismissed after his fiancée filed a complaint with the Equal Employment Opportunity Commission (EEOC) alleging discrimination based on her sex. The EEOC is responsible for enforcing federal employment discrimination laws in the US and can, among other things, file lawsuits on behalf of those affected. After a Kentucky court dismissed the fiancé’s claim and the Court of Appeals also followed this decision, the employee appealed to the Supreme Court, which affirmed a violation of the anti-discrimination provisions contrary to the previous decisions. The provisions of § 704 (a) of Title VII of the Civil Rights Act were to be interpreted broadly enough to cover a wide range of employers conduct.
