Legal Basis

“(2) Such  data  must  be  processed  fairly  for  specified  purposes  and  on  the  basis  of  the  consent  of  the person  concerned  or  some  other  legitimate  basis  laid  down  by  law.  Everyone  has  the  right  of  access  to data  which  has  been  collected  concerning  him  or  her,  and  the  right  to  have  it  rectified."

Public, scientific, and economic interests in information regarding social contexts results in large amounts of data collection. This collection of data is not always necessary, or socially responsible. It is the responsibility of the legislature to specify the framework in which the collection of, often sensitive, equality and participation data is allowed. Thereby, misuse can be prevented.

§ 13 of the Federal Data Protection Act provides that “the collection of personal data (§3 para. 9) is only allowed if (…) intended by a legislative provision or required for substantial public interest reasons.”
